Sea Dunes J-5 Rental Agreement

 

1.Please print out, sign, send and this agreement along with your first half payment, to secure your dates. Your dates will be held for 5 days while awaiting your payment. Payments may be made via credit card (3% fee) ; paypal (3% fee unless you use Friends & Family);check (sent to: Lynn Brau, 185 W Side LN, Powells Point, NC 27966), or through VRBO (if by e-check 10% fee, if by credit 3% fee). Trip insurance can be purchased when you use VRBO or through a third party like www.insuremytrip.com .

2.Your second ½ payment, plus your deposit ($50 for returning guests and $200 for new guests) is due 45 days before check in. Check-in information will be emailed to you 2 weeks prior to your stay.

3.Anyone booking within two weeks of stay must use credit card. This must be processed through squareup.com (I will send you an invoice) and there will be a service fee added (3%).

4.By renting this property you are assuming all risk of and liability for any damage done to person or property, agents, employees, or visitors occasioned by the present or future condition of the premises, both latent and manifest. We will not be responsible for accidents or injury to guest or loss of money or valuables of any kind.

5.We cannot guarantee air conditioners, televisions, VCRs, appliances, etc. No refund or rate adjustment will be made for mechanical failures. In case of breakdown, we will strive to repair it as soon as possible after being notified by you of the problem.

6There is no land-line in the unit. Please be sure you send me your cell phone numbers in case of emergency. The unit is Sea Dunes J-5.

7.Linens are furnished but you will need to bring beach towels. No linens will be exchanged during your stay. Please do not use white towels to clean faces with makeup. A $15 charge will be made for all hand towels or face cloths with makeup stain. There are makeup cleaning packets and colored face cloths in the unit.

8.The TOTAL NUMBER occupying the unit CANNOT EXCEED SIX. This is very important in the high season. Privileges in the clubhouse may be revoked if you exceed this number. This is a septic issue, and is very important!

9.THIS IS A NO-SMOKING UNIT. Evidence of smoking in the unit will cause forfeiture of entire rent and deposit and immediate tenant eviction. We have a smoke-free unit, and want to be sure it is a safe place for those with allergies. Please do not smoke in the unit, on the deck, or near the door.

10.NO PETS are allowed in or on vacation property premises. A pet or evidence of a pet found on premises will cause forfeiture of entire rent and deposit and immediate tenant eviction.

11.NO HOUSE PARTIES allowed. Violations are grounds for tenant eviction without refund or rent or deposit. No sororities, fraternities, school or civic groups allowed. WE DO NOT RENT TO GROUPS OF YOUNG PEOPLE UNDER THE AGE OF 25.

12.WE RESERVE THE RIGHT not to refund deposits, refuse rental or to discontinue occupancy if in our judgment your occupancy of the unit is detrimental to the property. As we reserve the right to enter the premises at any time for the purpose of inspection, repair, management or showing to prospective buyer. Property may not be used for any unlawful purpose.

13.If you must CANCEL or CHANGE DATES, on daily or weekly rental, a 30 DAY NOTICE PRIOR TO ARRIVAL must be given for your payment to be refunded or transferred. Fifty dollars ($50) will be charged for all cancellations. If less than 30 days notice is given, we will make every effort possible to re-rent the unit. If it is re-rented, the rest will be returned (minus the $50 cancellation fee). If the unit remains un-rented, only the deposit will be refunded.

14.In case of voluntary or involuntary evacuation (in case of hurricane), any reserved dates that you are unable (due to evacuation) to use, will be credited to you and can be used at another time. We highly recommend you purchase vacation insurance for September and October rentals.

15.Your deposit is placed in an account. This deposit DOES NOT APPLY TO RENT. OUR CHECK for your FULL DEPOSIT will be returned within 14 days after you check out and send us the evaluation, provided there is no damage, the unit is left reasonably clean (dishes, cookware, etc., must be washed and placed in cabinets), and trash is removed and placed in proper outside container. This includes leaving the garage the way you would like to find it. Please return all boogie boards and toys to the closet, line up bikes in the bike rack, and helmets on the ladder.

16.PARKING - There is a garage, and space for two vehicles outside. Additional vehicles or boats can be parked in front of the clubhouse, or by the gazebo near the entrance.

17.If the housekeeper has to remove trash, or do excessive cleaning or replace items to their proper locations, there will be an additional charge, as you are responsible to remove trash and any items from the refrigerator.

18. The bikes and outdoor toys are to be used at your own risk. Please check all equipment before you use it to be sure it is safe. If something is broken, please let me know. If broken in such a way that could injure someone, please throw in the trash. Be sure all used outdoor chairs and equipment are cleaned and put away. The housekeeper is not responsible for the garage, so please leave it the way you want to find it. THANK YOU!

 

 

YOUR SIGNATURE CERTIFIES that you have read this agreement and understand and agree to abide by it. YOUR SIGNATURE also certifies that you are an adult and financially responsible for any damage by parties present during your tenancy dates. Any reservation made under false pretense will result in loss of deposit and rent.
